Dear Mr Douglas,
In response to advertised proposal to stop part of this road.
On 16 December 1993 Peter Morton, Roading Manager, responded to
an official information request by stating that this matter will
lapse and will not be actioned pending being reported to a Council
committee. This letter is to confirm that course of action. We
are concerned that no correcting public advertisements have been
seen since this matter was first advertised for public submissions.
We reserve the right of further objection.
There are three sections of road subject to the current proposals.
That shown on plan SO 23951 (areas D and E) are justified and
should proceed. However we believe that there is no case for stopping
of unformed road 'F' on that plan.
Also areas 'A' and 'B' on plan SO 23953 provide legal access to
Deep Stream and are not 'unformed'. It consists of a historic
pack track which is benched and a vehicle track with water tables
and unmetalled carriageway. It is double-fenced most of its length.
It provides the only legal access to the north bank of Deep Stream
in its lower reaches.. The bed of the stream is public property.
There are 'Queen's Chain' reservations along both banks. The road
is needed for continued public vehicular and foot access to these
public lands and waters. We have inspected and used the road and
believe it to be ideally suited for fishing and other access to
the Creek. In the absence of alternative, practical access to
the north bank the public would be adversely affected if it were
to be 'stopped'. We do not agree that any lesser, alternative
rights of access would compensate for loss of legal road access.
Stopping of this road would be contrary to Council's duty, being
a matter of national importance under section 6(d) of the Resource
Management Act 1991, for the maintenance and enhancement of public
access to and along rivers.
We ask that stopping of this road proceed no further.
