Keeping an eye on public exclusion

 

Dublin Bay Recreation Reserve (NT 31)

This is a DOC administered reserve on the western shores of Lake Wanaka, near the outlet being New Zealand's largest river, the Clutha. Dublin Bay provides is a relatively sheltered shoreline and receives heavy day use for recreation. There are few obvious signs of development being a predominantly rural setting, with a spectacular alpine backdrop.

A corner of the nohoanga is marked only 20 metres from the shore. While nominal public access will be maintained along the shore, the intrusion of semi-permanent camps will cause a significant intrusion to the scene and reduce the open space available for the public to wander. Will the nohoanga provide an opportunity for freeholding, then permanent camping, subdivision, or development currently precluded by reserve status?

Ngai Tahu Claims Settlement Act 1998

"Section 257. Vesting of entitlement land--- (1) At the Crown's discretion, the Crown may vest in Te Runanga o Ngai Tahu an estate in fee simple in any [nohoanga] entitlement land".

 

Are there going to be different laws for different people?

The Ngai Tahu Claims Settlement Act-

Section 260. Obligations related to nohoanga entitlements-
Sebsection (4) "The holder, and the activities carried on by the holder on the entitlement land ... are subject to all laws, bylaws, regulations, and land and water management practices relating to the entitlement land".
